Vibe Store Terms of Service

Last Updated & Effective Date: March 22, 2025

Welcome to Vibe Store, a product operated by Gazman Dev LLC ("we," "us," or "our"). By accessing or using the Vibe Store located at bulifier.com, you ("user," "you," or "your") agree to comply with and be bound by these Terms of Service. If you do not agree with these terms, please do not use the Vibe Store.

1. Acceptance of Terms

By accessing or using the Vibe Store, you acknowledge that you have read, understood, and agree to these Terms of Service, including any updates or modifications. Continued use of the Vibe Store constitutes your acceptance of any changes.

2. Description of Service

Bulifier Vibe Store provides a platform that grants access to games and applications ("Apps") created and published by users via the Bulifier AI Android app. These Apps are intended for personal entertainment and use. We do not pre-screen or review Apps prior to publication; however, we reserve the right to remove any App that is found to be harmful, abusive, or in violation of these Terms.

3. User Conduct

You agree to:

  • Use Apps solely for personal, non-commercial purposes.
  • Refrain from circumventing security measures or accessing areas of the Vibe Store for which you are not authorized.
  • Avoid engaging in illegal activities or conduct that may harm others, including (but not limited to) hate speech, defamation, harassment, spamming, or any activity that infringes on the rights of others.
  • Understand that violations of these Terms, including repeated or severe breaches, may result in immediate suspension or termination of your access to the Vibe Store without prior notice.

4. Content Availability

All Apps available on the Vibe Store are created and published by third-party users. While we do not review Apps prior to their publication, we reserve the right to remove any App that is harmful, abusive, or in violation of these Terms. Removal decisions may be based on internal assessments and user reports, and such actions are taken at our sole discretion.

5. Restrictions on Apps

Apps published on the Vibe Store are prohibited from:

  • Accessing external or third-party domains without explicit authorization.
  • Running advertisements or collecting user analytics data beyond what is permitted by our guidelines.
  • Engaging in activities that may compromise the security or integrity of the Vibe Store or its users.

Developers are expected to ensure their Apps comply with these restrictions to maintain a safe and secure environment.

6. Data Collection

Bulifier Vibe Store uses Google Analytics to collect anonymized, aggregated usage data—including metrics such as page views, session durations, and user interactions—to improve the user experience. We do not collect personally identifiable information from Vibe Store users. By using the Vibe Store, you consent to this data collection. For more details on our data practices and compliance with GDPR, CCPA, and other applicable laws, please refer to our Privacy Policy.

7. Intellectual Property Rights

Gazman Dev LLC retains ownership of the Vibe Store platform, including its design, layout, and operational logic. You retain ownership of the intellectual property rights to the Apps you create and publish. By publishing an App on the Vibe Store, you grant Gazman Dev LLC a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and promote your App as necessary for the operation, maintenance, and marketing of the Vibe Store. Should an App be removed or your access terminated, you retain all rights to your content, though the granted license may continue as necessary for operational purposes.

8. Disclaimer of Warranties

The Vibe Store and all Apps are provided "as is" and "as available" without any warranties of any kind, whether express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Gazman Dev LLC does not warrant the safety, accuracy, or reliability of any App, and your use of the Vibe Store is at your own risk.

9. Limitation of Liability

Gazman Dev LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Vibe Store or any App, even if advised of the possibility of such damages. This limitation applies to all claims, regardless of the legal theory upon which they are based.

10. Dispute Resolution

Any disputes arising out of or related to these Terms or your use of the Vibe Store shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. Details regarding the arbitration process are provided in our separate Arbitration Policy. To the extent permitted by law, you may have the right to opt out of arbitration. By using the Vibe Store, you agree to resolve disputes through arbitration rather than litigation.

11. Account Termination and Enforcement

Gazman Dev LLC reserves the right to suspend or terminate access to the Vibe Store for any user who violates these Terms. Although user accounts are not authenticated and we do not collect direct contact information, enforcement actions may be taken through technical measures. Decisions regarding termination are made at our sole discretion and without prior notice, though we strive to provide explanations when feasible.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page and become effective immediately upon posting. When significant changes are made, we will provide a prominent notice on the Vibe Store. Your continued use of the Vibe Store constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of laws principles.
